On Dec. 6 in the county court, Judge William E. Baldwin resentenced Mark A. Smith Jr., 25, of Pottsville, to serve three to 12 months in prison, with sentence effective at 6 p.m. Dec. 28, after revoking his probation.
Baldwin ruled Smith had violated his probation by not reporting to his supervising officer and not paying on his fines and costs.
"You just blew us off," an irritated Baldwin told Smith.
Smith originally pleaded guilty on May 18, 2011, to possession of drug paraphernalia, driving unregistered vehicle and operating vehicle without valid inspection, with prosecutors withdrawing charges of possession of marijuana and improper use or display of documents. At that time, Baldwin placed him on probation for 12 months and also sentenced him to pay costs, $100 in fines, $100 to the Substance Abuse Education Fund, $50 to the Criminal Justice Enhancement Account and $176 restitution to the state police crime laboratory in Bethlehem.
Pottsville police had charged Smith with committing his offenses on Sept. 27, 2010, in the city.
In another Dec. 6 case, Baldwin ordered Brian R. Kehl, 29, of Lansford, returned to prison after revoking his parole.
Kehl must remain in prison for six months before applying for parole again, and could stay behind bars until March 13, 2014, under the terms of Baldwin's order.
Kehl originally pleaded guilty on to June 14, 2010, to driving under the influence, possession of a controlled substance, possession of drug paraphernalia, driving under suspension and not using low beams. Baldwin sentenced him to serve 72 hours to six months in prison and pay costs, $1,225 in fines, $100 SAEF payment, $50 CJEA payment, a $50 bench warrant fee and $176 restitution to the state police crime laboratory in Bethlehem.
Coaldale police had alleged Kehl was DUI, and possessed drugs and drug paraphernalia, on June 26, 2009, in the borough.
In recent Schuylkill County Court action, Judge Charles M. Miller accepted guilty pleas from, and, pursuant to plea agreements between prosecutors and defendants, accepted guilty pleas from, these people:
Albert Gonzalez, 36, of Temple; possession of drug paraphernalia; 12 months probation, $100 payment to the Substance Abuse Education Fund and $113 restitution to the state police crime laboratory in Bethlehem. Prosecutors dropped a charge of conspiracy.
Shirley Lee Greising, 28, of Lost Creek; forgery, theft by deception and access device fraud; one to 23 months in prison, $50 payment to the Criminal Justice Enhancement Account, $532.66 restitution and submission of a DNA sample to law enforcement authorities. Prosecutors dropped charges of identity theft, theft and receiving stolen property.
Mary L. Hardy, 42, of Shenandoah; defiant trespass and harassment; 12 months probation, $50 CJEA payment, no contact with the victim and drug and alcohol and mental health evaluations. Prosecutors dropped charges of loitering and prowling at nighttime and public drunkenness.
Jennifer S. Lenker, 40, of Lancaster; three counts of unlawful sale of tobacco; $475 in fines. Prosecutors dropped three counts each of corruption of minors and selling or furnishing liquor to minors.
Michael P. Levandusky, 23, of Shenandoah; terroristic threats and bomb threats; 35 days to 23 months in prison, two years consecutive probation and $50 CJEA payment.
Brian McDonald, 33, of Shenandoah; theft; 23 months probation, $50 CJEA payment and $1,360 restitution. Prosecutors dropped a charge of receiving stolen property.
Marcia L. Messinger, 45, of New Ringgold; six counts of access device fraud and one of retail theft; 23 months probation, $50 CJEA payment and $520.68 restitution.
Michael W. Moore, 37, of Saint Clair; resisting arrest and accident involving damage to unattended vehicle or property; 23 months probation, $300 fine, $50 CJEA payment and $500 restitution.
Joshua A. Mullins, 21, of Valley View; theft; 12 months probation and $50 CJEA payment. Prosecutors dropped a charge of defiant trespass.
Jessica A. Pauly, 28, of Minersville; two counts of endangering the welfare of children and one each of driving under the influence, disregarding traffic lane and failure to drive at a safe speed; 12 months probation, $1,050 in fines, $300 SAEF payment and $60 restitution to Schuylkill Medical Center-South Jackson Street. Prosecutors dropped two counts of recklessly endangering another person and one of careless driving.
Michael Putalavage, 23, of Minersville; possession with intent to deliver a controlled substance; 23 months probation, $100 SAEF payment, $50 CJEA payment, $113 restitution to the state police crime laboratory in Bethlehem and submission of a DNA sample to law enforcement authorities. Prosecutors dropped charges of possession of a controlled substance and criminal use of a communication facility.
Matthew T. Reber, 23, of Schuylkill Haven; possession of a controlled substance and possession of drug paraphernalia; 31 days to 11 1/2 months in prison, $350 in fines, $300 SAEF payment, $50 CJEA payment and $113 restitution to the state police crime laboratory in Bethlehem. Prosecutors dropped charges of delivery of a controlled substance and possession with intent to deliver a controlled substance.
Kayla L. Reinhart, 21, of Saint Clair; access device fraud, theft and receiving stolen property; two days to 18 months in prison with immediate parole, $50 CJEA payment and $270.79 restitution. Prosecutors dropped charges of altering access device and conspiracy.
James B. Roche, 48, of Ashland; possession of a controlled substance and possession of drug paraphernalia; 35 days to 12 months in prison with immediate parole, $100 SAEF payment, $50 CJEA payment and drug and alcohol evaluation. Prosecutors dropped three additional counts of possession of a controlled substance.
All defendants who were sentenced must pay costs as a part of their sentences.
