Geoffrey M. Mosolino is again a wanted man after he did not show up Monday in Schuylkill County Court for a hearing on whether to revoke his probation, which the judge decided to do in his absence.
Mosolino, 31, of Pottsville, violated several terms of his probation and should serve three to 23 months in prison, Judge John E. Domalakes decided.
"It appears he has not been under any supervision," Domalakes said before imposing the sentence, which was the amount Assistant District Attorney Robert E. Matta had requested.
The judge also issued a bench warrant for Mosolino, who will be sent to prison when he is captured.
Domalakes ruled Mosolino had violated the terms of his probation by not reporting to his supervising officer since November 2010, moving without permission from his former residence in Schuylkill Haven, not maintaining employment, failing to make regular payments on his costs, fines and restitution, and not providing any evidence he had performed his required community service.
Mosolino originally pleaded guilty on Aug. 27, 2009, to theft and receiving stolen property. At that time, Domalakes placed him on probation for 23 months and also sentenced him to perform 10 hours community service and pay costs, a $100 fine, $50 to the Criminal Justice Enhancement Account and $85 restitution, amounts Mosoliino is still liable for under the terms of Monday's sentence.
Pottsville police had charged Mosolino with committing the theft on March 17, 2008, in the city.
This is the third time a judge has issued a bench warrant for Mosolino.
The first occurred on Nov. 3, 2008, when President Judge William E. Baldwin issued the bench warrant after Mosolino did not show up on Oct. 23, 2008, for the call of the trial list.
Domalakes himself issued the second bench warrant for Mosolino on Aug. 4, 2011, after declaring him an absconder.
Chief County Detective Dennis Clark said the search for Mosolino will start immediately.
"We'll start by contacting the last known address," he said.
Clark said Mosolino will be listed with the National Crime Information Center, the country's central database for tracking criminals.
He also said that while it is not common for one person to have three bench warrants issued against him, it is not unprecedented.
