PORT CARBON - A 49-year-old Saint Clair man arrested by Saint Clair police after an incident at East Railroad and South Front streets on Dec. 2, 2011, waived his right to a preliminary hearing before Magisterial District Judge David A. Plachko.
Nicholas M. Kostishak, of 323 S. Mill St., was arrested by Saint Clair police Chief Michael Carey and charged with one count each of resisting arrest, disorderly conduct and public drunkenness. By waiving his right to a hearing, Kostishak will have to answer to all three charges in Schuylkill County Court.
Carey said he was in the area for an earlier problem when Kostishak exited the Sand Castle bar, walked toward him and two other people and began to yell and curse.
Carey said he told the man to go home before he gets arrested for public drunkenness and disorderly conduct, but the man continued to be abusive, began to walk toward him and then resisted being taken into custody, needing the use of a Taser to be subdued.

Charles D. Henderson, 30, of 929 Scott St., Kulpmont - waived to court: retail theft, harassment and conspiracy.
Elizabeth N. Henderson, 20, of 929 Scott St., Kulpmont - waived to court: retail theft, defiant trespass, harassment and conspiracy.
Scott A. Birk, 39, of 312 S. Second St., Saint Clair - withdrawn: reckless driving. Waived to court: DUI, driving while operating privileges are suspended or revoked and possession of drug paraphernalia.
