Stephen J. Bayer

TAMAQUA - A 35-year-old Tamaqua man charged with assaulting another man in the borough on Dec. 2, 2012, had charges against him held to court during a preliminary hearing before Magisterial District Judge Stephen J. Bayer.

Shawn W. Clemens, 6 Bolgash Lane, was arrested by Tamaqua police Patrolman Joseph Krebs and charged with aggravated assault, simple assault, harassment, disorderly conduct and public drunkenness.

Bayer determined the commonwealth proved a prima facie case and ordered all five offenses held for Schuylkill County Court.

Krebs charged Clemens with assaulting Thomas Carroll after the two had been drinking all day. Krebs said that prior to the fight, Clemens and Carroll exited a home at 626 E. Broad St., walking toward a vehicle when the fight started.

Witnesses told police Clemens struck Carroll in the face with a fist about six times, causing him to fall to the ground unconscious.

Carroll was unresponsive for about 10 minutes and Krebs said he learned that Clemens tried to start fights with several individuals throughout the day.

Patrick B. McCarthy, 29, of 722 S. Kennedy Drive, McAdoo - withdrawn: resisting arrest. Moved to a non-traffic citation: harassment.

Zachary D. Pisanchyn, 20, of 171 Sunny Drive, MaryD - withdrawn: DUI-controlled substance. Waived for court: DUI, DUI-controlled substance, DUI-minor and driving at an unsafe speed.

James W. Freiling, 30, of 323 W. Broad St., Apt. 4, Tamaqua - waived for court: DUI, DUI-high rate and disregard for single traffic lane.

Pablo Almodovar, 46, of 1010 3A Elm St., Easton - withdrawn: criminal trespass and defiant trespass. Waived for court: terroristic threats.

Jennifer Harris, 24, of 133 S. Hancock St., McAdoo - waived for court: DUI, failure of duties at a stop sign, failure to yield at a yield sign, improper turning movements and required signals, no headlights and careless driving.

Crystal Ann Motzer, 23, of 14 S. Lehigh St., Tamaqua - withdrawn: theft by unlawful taking and receiving stolen property.

Daniel D. Faust, 56, of 235 Lombard St., Tamaqua - dismissed: simple assault and harassment.

Anthony F. Chesla, 28, of 55 Wayne Ave., Tamaqua - dismissed: theft by unlawful taking and receiving stolen property.

Kathy Carroll, 40, of 187 Owl Creek Road, Tamaqua - dismissed: simple assault and harassment.

Jacob A. Bynon, 31, of 305 Patterson St., Lansford - withdrawn: simple assault and harassment.

Alicia R. Whah, 25, of 114 Patterson St., Tamaqua - withdrawn: simple assault and harassment.

Anthony C. Houser, 22, of 16 Schuylkill Ave., Tamaqua - withdrawn: simple assault and harassment.

Michael J. Brodie, 27, of 231 W. Sherman St., Apt. 3, McAdoo - held for court: terroristic threats, resisting arrest, disorderly conduct, public drunkenness and harassment.

Jessica L. Wansik, 33, of 238 Maple St., Freeland - withdrawn: burglary and loitering and prowling at night. Waived for court: criminal trespass and receiving stolen property.

Stephen W. Simchak, 56, of 167 Lake Drive, Nesquehoning - withdrawn: fleeing or attempting to elude police. Waived for court: DUI, failure to yield to an emergency vehicle, disregard for single traffic lane and turning movements and required signals.

Justin C. Mattson, 23, of 131 Brandywine Drive, Irwin - dismissed: possession of marijuana, possession of drug paraphernalia, driving with a suspended or revoked license, failure to notify police of an accident, accidents involving damage to unattended vehicles or property, driving at an unsafe speed and careless driving.
