A Berks County man admitted Monday in Schuylkill County Court that he possessed heroin in October 2004 in Tower City.

However, Terry L. Wolff, 54, of Stouchsburg, will not have to spend more time in prison after pleading guilty to possession of a controlled substance.

Judge Jacqueline L. Russell accepted Wolff's plea and, pursuant to an agreement between prosecutors and the defendant, sentenced him to spend 15 days to 12 months in prison and pay costs, a $50 fine, $100 to the Substance Abuse Education Fund, $50 to the Criminal Justice Enhancement Account and $105 restitution to the state police crime laboratory in Bethlehem.

Russell made the prison sentence concurrent with the Dauphin County one Wolff already is serving at State Correctional Institution/Coal Township.

Wolff remained at SCI/Coal Township while Monday's hearing was conducted by videoconference.

Tower City police charged Wolff with possessing the heroin on Oct. 10, 2004, at a traffic stop in the borough.

"The driver said, 'Take this and stick it away,' " Wolff said of the events at the stop, where he was a passenger in the vehicle. However, Wolff said he knew there was heroin in the syringe.

Wolff pleaded guilty on Dec. 18, 2008, in Dauphin County Court to involuntary deviate sexual intercourse, indecent assault, indecent exposure unlawful contact or communication with a minor and corruption of minors. Judge Scott A. Evans accepted the plea and, on May 14, 2009, sentenced him to spend six to 12 years in a state correctional institution, pay costs and a $1,000 fine, and submit a DNA sample to law enforcement authorities.

State police at Lykens had charged Wolff with assaulting a child on Jan. 1, 1998.

Also on Monday, Russell revoked the probation of Robert W. Enloe Jr., 24, of Girardville, and sentenced him to serve 30 days to 23 months in prison.

Enloe admitted violating his probation by being charged with a new crime.

Enloe originally pleaded guilty on March 23, 2011, to forgery and attempted counterfeiting or simulating mark or stamp, with prosecutors withdrawing a charge of attempted acquisition of a controlled substance by misrepresentation. Russell accepted his plea, placed him on probation for 23 months and also sentenced him to pay costs and a $50 CJEA payment, amounts he still must pay under the terms of Monday's new sentence.

Ashland police charged Enloe with committing his crimes on June 13, 2010, in the borough.

In another Monday case, Russell revoked the parole of Dale A. Schaeffer, 30, of Norristown, but immediately paroled him to the custody of Montgomery County.

Schaeffer originally pleaded guilty on Feb. 18, 2010, to burglary, conspiracy, criminal trespass and theft, with prosecutors dropping a charge of criminal mischief. Russell accepted Schaeffer's plea and sentenced him to spend one to 23 months in prison, pay costs, a $50 CJEA payment and $2,260 restitution, perform 60 hours community service and submit a DNA sample to law enforcement authorities.

State police at Frackville charged Schaeffer with committing his crimes on July 7, 2009.

Schaeffer admitted violating his parole by using drugs, not making payments toward his costs and fines, not completing his drug and alcohol treatment and not performing community service.

Russell revoked Schaeffer's for the first time on Oct. 25, 2011.

In other recent county court action, Judge Cyrus Palmer Dolbin accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:

Duane R. Allen II, 25, of Tamaqua; theft - 12 months probation and $50 CJEA payment. Prosecutors withdrew a charge of receiving stolen property.

Felicia Bigg-Carr, 22, of Lansford - resisting arrest and disorderly conduct; 23 months probation and $50 CJEA payment. Prosecutors withdrew a second count of disorderly conduct and a charge of escape.

Joseph Carroll, 43, of Tamaqua - driving under the influence; six months in the intermediate punishment program, $1,000 fine, $300 SAEF payment and $60 restitution to Schuylkill Medical Center-South Jackson Street. Prosecutors withdrew a charge of improper tires.

Melanie D. Delowery, 24, of Frackville - DUI and driving under suspension; five years in the intermediate punishment program, $1,700 in fines $300 SAEF payment. Prosecutors withdrew charges of possession of a small amount of marijuana, possession of drug paraphernalia, careless driving and disregarding traffic lane.

Dillon Friendy, 19, of Hazleton - two charges of DUI and one each of possession of drug paraphernalia and no rear lights; six days to six months in prison with immediate parole, 12 months consecutive probation, $2,025 in fines, $400 in SAEF payments and $120 restitution to Schuylkill Medical Center-South Jackson Street. Prosecutors withdrew charges of possession with intent to deliver a controlled substance, possession of a small amount of marijuana and improper sunscreening.

Michael C. Hill Jr., 21, of Lehighton - DUI, recklessly endangering another person, failure to keep right, failure to drive at a safe speed and abandoning vehicle; 72 hours to six months in prison, 18 months probation, $1,075 in fines, $100 SAEF payment, $50 CJEA payment, $64,641.60 restitution and 20 hours community service. Prosecutors withdrew charges of accident involving death or personal injury, disregarding traffic lane, driving on the sidewalk, careless driving, failure to report accident, accident involving damage to unattended vehicle or property, failure to notify police of accident and purchase, consumption, possession or transportation of an intoxicating beverage by a minor.

Daniel P. Kelly, 31, of Old Forge - DUI and disregarding traffic lane; 48 hours to six months in prison with immediate parole, $525 in fines, $100 SAEF payment, $50 CJEA payment and $60 restitution to Schuylkill Medical Center-South Jackson Street. Prosecutors withdrew charges of unsigned registration card and careless driving.

Gabriel X. Thomas, 29, of Cumbola - two counts of simple assault and one each of aggravated assault and recklessly endangering another person; nine to 23 months in prison, $50 CJEA payment, $3,497.20 restitution and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew and additional count of recklessly endangering another person and charges of theft, criminal mischief and harassment.

In other recent county court action, President Judge William E. Baldwin accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:

Scott M. Mentzer, 43, of Pine Grove - accident involving death or personal injury, habitual offender, operating vehicle without required financial responsibility and suspended vehicle registration; six to 12 months in a state correctional institution consecutive to current sentence and $600 in fines.

Christopher M. Sallaway, 20, of Mahanoy City - theft; 12 months probation, $50 CJEA payment, $50 bench warrant fee and $150 restitution.

Rocci A. Shuima III, 34, of Tamaqua - possession of drug paraphernalia; 12 months probation, $100 SAEF payment and $50 CJEA payment.

Aaron T. Tullock, 21, of Saint Clair - receiving stolen property, unlawful sale or transfer of firearm and loitering and prowling at nighttime; 52 days to 11 months in prison, 12 months consecutive probation, $50 CJEA payment, $50 bench warrant fee and 20 hours community service.

Robert Vandaley, 29, of Pottsville - driving under the influence, driving under suspension, improper operation on street and driving wrong way; 15 months to five years in a state correctional institution, $2,600 in fines, $100 SAEF payment, $50 CJEA payment, $50 bench warrant fee, $60 restitution to Schuylkill Medical Center-South Jackson Street and 60 hours community service. Prosecutors withdrew a charge of operating vehicle without required financial responsibility.

Ryan Winkler, 33, of Frackville - defiant trespass; 12 months probation consecutive to current sentence and $50 CJEA payment.

All defendants who were sentenced must pay costs as a part of their sentences.
