A Lancaster man will spend more time behind state prison bars after being sentenced Friday in Schuylkill County Court for assaulting a corrections officer.
Warren Riley, 33, must spend three to 23 months in a state correctional institution under the terms of Judge James P. Goodman's sentence on two counts of simple assault.
Goodman, who made the prison term consecutive to ones Riley already is serving from Lancaster County Court for drug and assault crimes, also sentenced Riley to pay costs and $50 to the Criminal Justice Enhancement Account.
Assistant District Attorney Michael A. O'Pake said Riley assaulted a corrections officer at SCI/Mahanoy.
Goodman also sentenced Megan McCabe, 20, of Tamaqua, on Friday to serve 30 days to 23 months in prison with immediate parole, pay costs and $176 restitution to the state police crime laboratory in Bethlehem, undergo a drug and alcohol evaluation, perform 20 hours community service and submit a DNA sample to law enforcement authorities.
McCabe pleaded guilty on Jan. 31 to delivery of a controlled substance, possession with intent to deliver a controlled substance, possession of a controlled substance and possession of drug paraphernalia.
Schuylkill County detectives had charged McCabe with selling drugs on Feb. 7, 2012.
"She doesn't have any prior involvement with the law," O'Pake said in explaining why he did not seek more prison time for McCabe.
In other recent county court action, President Judge William E. Baldwin on Wednesday accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:
Toni A. Chester, 27, of Ringtown; delivery of a controlled substance and possession of drug paraphernalia; six to 23 months in prison, $100 payment to the Substance Abuse Education Fund, $113 restitution to the state police crime laboratory in Bethlehem and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew a charge of possession with intent to deliver a controlled substance.
Jonathan S. Delgado, 24, of Reading; possession of a controlled substance and possession of drug paraphernalia; 11 to 24 months in a state correctional institution, $100 SAEF payment and $113 restitution to the state police crime laboratory in Bethlehem. Prosecutors withdrew a charge of possession with intent to deliver a controlled substance.
Todd D. Dohner, 47, of Pine Grove; indecent exposure and harassment; 36 months probation, $100 in CJEA payments, mental health evaluation and no contact with victims. Prosecutors withdrew an additional charge of indecent exposure, two additional ones of harassment and one of disorderly conduct.
John J. Ennis, 39, of Ashland; driving under the influence and disregarding traffic lane; 25 days house arrest, 35 days strict supervision, four months probation, $325 in fines, $100 SAEF payment and 20 hours community service.
All defendants who were sentenced must pay costs as a part of their sentences.
