Already facing state prison time for indecently assaulting a girl, a Schuylkill Haven man faces more prison time after being resentenced Wednesday in Schuylkill County Court following revocation of his probation in a second case and his parole in a third.
Alan R. Donmoyer, 32, must remain in prison until Dec. 27, 2017, on a charge of driving under the influence, and serve six to 12 months in a state correctional institution on a charge of defiant trespass, Judge Cyrus Palmer Dolbin ruled.
Dolbin imposed the new sentence after revoking Donmoyer's probation and parole.
He ruled Donmoyer had violated the conditions of both by engaging in new criminal activity, driving without a license and not completing his drug and alcohol treatment.
"Yes, Your Honor," Donmoyer said to Dolbin when asked if he had committed those violations.
The most serious violation, the new criminal activity, is what landed Donmoyer in a state correctional institution.
Donmoyer pleaded guilty on Feb. 20 to one count of aggravated indecent assault and two of corruption of minors. President Judge William E. Baldwin accepted the plea and, on March 4, sentenced him to serve five to 10 years in a state correctional institution, pay costs and $50 to the Criminal Justice Enhancement Account and submit a DNA sample to law enforcement authorities.
Hegins Township police filed the charges against Donmoyer, alleging he assaulted the girl on July 16, 2012, in the township. Assistant District Attorney Michael A. O'Pake said at the time of the plea that the girl was 14 years old when the assault occurred in the area of Old Mill Road.
Donmoyer admitted assaulting the girl when interviewed, according to police.
The two cases for which Donmoyer returned to court Thursday involved separate incidents in 2010 in Pottsville.
He had pleaded guilty on August 26, 2010, to DUI and driving under suspension in the one case and defiant trespass in the other. Dolbin accepted his pleas and sentenced him to spend 90 days to five years in prison, plus 12 additional months on probation, and pay costs, $1,700 in fines, $300 to the Substance Abuse Education Fund and $60 restitution to Schuylkill Medical Center-South Jackson Street.
Pottsville police filed both sets of charges against Donmoyer, alleging he was DUI on Feb. 8, 2010, and trespassed on April 7, 2010.
