A Saint Clair man returned to prison after being sentenced Thursday in Schuylkill County Court following revocation of his probation in a case involving a February 2012 theft.

Justin M. Marx, 23, must spend nine to 23 months on probation, plus an additional 12 months on probation, and undergo a drug and alcohol evaluation under the terms of Judge Cyrus Palmer Dolbin's new sentence.

Dolbin ruled that prosecutors had proven it was more likely than not that Marx had violated the law in two other incidents, one involving an alleged robbery and the other purportedly involving a chase with police.

"He has repeatedly proven that he is not a good candidate for probation," Dolbin said. "He is a danger."

Marx originally pleaded guilty on Sept. 7, 2012, to theft, receiving stolen property and defiant trespass, with prosecutors dropping charges of burglary and driving under suspension. At that time, Dolbin placed Marx on probation for four years and also sentenced him to pay costs, $50 to the Criminal Justice Enhancement Account and $1,666.66 restitution.

State police at Frackville alleged that Marx committed the theft on Feb. 9, 2012.

In other recent county court action, President Judge William E. Baldwin accepted guilty plea from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:

Randal L. Fisk, 26, of Middleport; two charges of DUI and one each of possession of a small amount of marijuana, possession of prohibited offensive weapon, disregarding traffic lane and careless driving; six days to one year in prison, 12 months consecutive probation, $2,050 in fines, $200 in SAEF payments, $120 restitution to Schuylkill Medical Center-South Jackson Street and 10 hours community service.

Fisk admitted DUI on consecutive days, on Aug. 5, 2012, in Minersville, and on Aug. 6, 2012, in Schuylkill Haven.

"Two DUIs in two days? I don't think that's funny," Baldwin told Fisk.

Sara M. Fletcher, 21, of Tresckow; harassment; $100 fine. Prosecutors dropped two counts of simple assault and one each of conspiracy and criminal mischief.

Thomas Howard, 56, of Pottsville; retail theft; 12 months probation consecutive to current sentence, $16.25 restitution and 20 hours community service.

Brandon D. Huff, 20, of Reading; loitering and prowling at nighttime, possession of a small amount of marijuana and possession of drug paraphernalia; 23 months probation, $100 SAEF payment, $226 restitution to the state police crime laboratory in Bethlehem and 10 hours community service.

Bonnie L. James, 58, of Pottsville; theft by deception, securing execution of documents by deception and unsworn falsification to authorities; 18 months probation, $50 CJEA payment and 20 hours community service. Prosecutors dropped charges of tampering with public records and receiving stolen property.

Gina M. Keiter, 30, of Pottsville; delivery of a controlled substance, possession with intent to deliver a controlled substance and criminal use of a communication facility; 90 days house arrest, $100 SAEF payment, $113 restitution to the state police crime laboratory in Bethlehem, $40 restitution to Pottsville police and submission of a DNA sample to law enforcement authorities, with sentence effective on April 8. Prosecutors dropped a charge of possession of drug paraphernalia.

Benjamin P. Kline, 26, of Pottsville; possession of drug paraphernalia; 12 months probation and $100 SAEF payment. Prosecutors dropped a charge of defiant trespass.

Neil K. Langtry, 55, of Schuylkill Haven; DUI and disregarding traffic lane; 30 days in prison, 90 days house arrest with electronic monitoring, 30 days alcohol monitoring, seven months strict supervision, four years probation, $1,525 in fines, $100 SAEF payment and 40 hours community service. Prosecutors dropped charges of careless driving and seat belt violation.

Andrew S. Lehman, 30, of Pottsville; no contest plea to receiving stolen property; 12 months probation and $166 restitution.

All defendants who were sentenced must pay costs as a part of their sentences.
