A West Penn Township man is headed to prison after having his probation revoked April 3 in Schuylkill County Court.
Derek P. Snyder, 26, of Andreas, must spend three to 12 months behind bars, Judge John E. Domalakes ruled.
"All you had to do was stay out of trouble, stay away from drugs," in order to avoid prison, Domalakes told Snyder.
Domalakes revoked Snyder's probation after the defendant admitted violating its terms by failing to report to his supervising officer, moving without permission, failing three drug tests, using drugs and failing to pay costs.
Snyder originally was admitted into the Accelerated Rehabilitative Disposition program on July 15, 2010, by Baldwin after being charged with possession of a small amount of marijuana and possession of drug paraphernalia.
State police at Reading charged Snyder with possessing marijuana and paraphernalia on Sept. 23, 2009.
However, Baldwin removed Snyder from the ARD program on Jan. 3, 2012, and the defendant subsequently pleaded guilty on April 18, 2012, before Domalakes to the two crimes.
At the time of Snyder's plea, Domalakes placed him on probation for 12 months and also sentenced him to pay costs, a $100 SAEF payment, $50 to the Criminal Justice Enhancement Account and $176 restitution to the state police crime laboratory in Bethlehem, amounts he still must pay under the terms of the sentence.
"I certainly urge you to ⦠do everything you need to do" to solve his problems, Domalakes told Snyder.
On April 4 a Pottsville man admitted in Schuylkill County Court that he unlawfully sold a prescription drug in May 2012 to an undercover police officer.
Kristian A. Carl, 24, pleaded guilty to delivery of a controlled substance and possession of a controlled substance.
Judge Charles M. Miller accepted Carl's plea, ordered preparation of presentence investigation and scheduled his sentencing for 1:30 p.m. May 9.
Minersville police charged Carl with selling the drug for $40 to an undercover officer on May 7, 2012, in the borough.
Carl remains free on $25,000 unsecured bail pending his sentencing.
Also on April 4, David J. Kupusnick, 39, of Minersville, pleaded no contest to charges of selling a noncontrolled substance represented to be a controlled substance and conspiracy.
By pleading no contest, Kupusnick did not admit committing the crimes, but offered no defense to them, agreed prosecutors had enough evidence to prove him guilty beyond a reasonable doubt and agreed to be sentenced as if he had pleaded or been found guilty.
Miller also accepted Kupusnick's plea, ordered preparation of presentence investigation and scheduled his sentencing for 1:30 p.m. May 9.
Minersville police charged Kupusnick with selling 20 pills of Oxycodone for $450 on April 13, 2012, in the borough.
Kupusnick remains free on $10,000 percentage bail pending his sentencing.
In another case, John A. Gallagher Jr., 58, of Scotrun, pleaded guilty to two counts of bad checks.
Miller also accepted Gallagher's plea, ordered preparation of presentence investigation and scheduled his sentencing for 1:30 p.m. May 9.
State police at Schuylkill Haven alleged Gallagher passed two bad checks, one for $3,000 and the other for $2,000, on Oct. 31, 2011, to Top Guns, 7 Builtwell Road, Schuylkill Haven, North Manheim Township.
Gallagher remains free on $5,000 unsecured bail pending his sentencing.
Also in the county court, prosecutors dropped charges of aggravated assault, terroristic threats, simple assault and recklessly endangering another person against Jillian T. Fisher, 31, of Pottsville.
Pottsville police had charged Fisher with committing those crimes on Oct. 9, 2012, in the city.
President Judge William E. Baldwin signed an order allowing prosecutors to drop the charges and directing Fisher to pay the costs of the case.
