In recent Schuylkill County Court action, Judge Jacqueline L. Russell accepted guilty pleas from, and, pursuant to plea agreements between prosecutors and defendants, imposed the indicated sentences on, these people:
Michael J. Flaherty, 50, of McAdoo - possession with intent to deliver a controlled substance; six to 23 months in prison, $100 payment to the Substance Abuse Education Fund, $50 payment to the Criminal Justice Enhancement Account, $113 restitution to the state police crime laboratory in Bethlehem and submission of a DNA sample to law enforcement authorities, with sentence effective at 9 a.m. May 8. Prosecutors withdrew a charge of possession of a controlled substance.
Flora E. Ptaszkowski, 31, of Shenandoah - simple assault, disorderly conduct and possession of drug paraphernalia; one to 12 months in prison with immediate parole, 12 months consecutive probation, $50 CJEA payment, 20 hours community service and drug and alcohol evaluation. Prosecutors withdrew charges of harassment and public drunkenness.
David J. Rich, 40, of Mahanoy City - simple assault; time served to 18 months in prison with immediate parole, $50 CJEA payment, 20 hours community service and no contact with the victim. Prosecutors withdrew an additional count of simple assault and charges of aggravated assault, possessing instrument of crime and recklessly endangering another person.
Mahanoy City police charged Rich with assaulting a man with a razor Nov. 21, 2012, in the borough.
Brandon Wehry, 28, of Elysburg - possession with intent to deliver a controlled substance and possession of drug paraphernalia; nine to 23 months in prison, $100 SAEF payment, $50 CJEA payment, $50 bench warrant fee, $113 restitution to the state police crime laboratory in Bethlehem, 20 hours community service and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew a charge of possession of a controlled substance.
Christopher Whalen, 32, of Schuylkill Haven - resisting arrest; time served to 23 months in prison with immediate parole, $50 CJEA payment, 20 hours community service and drug and alcohol evaluation. Prosecutors withdrew charges of terroristic threats, simple assault, recklessly endangering another person and harassment.
Edward E. Whitehead III, 28, of Andreas - driving under the influence; 72 hours to six months in prison, $1,000 fine, $100 SAEF payment, $50 CJEA payment, $60 restitution to Schuylkill Medical Center-South Jackson Street and 20 hours community service. Prosecutors withdrew a charge of disregarding traffic lane.
Mark Yacovelli, 43, of Shenandoah - harassment; $300 fine. Prosecutors withdrew a charge of possession of drug paraphernalia.
Wayne R. Zimmerman, 62, of Middleport - DUI; 10 days in prison, 40 days on house arrest with electronic monitoring, 40 days strict supervision, three months probation, $750 fine, $100 SAEF payment, $50 CJEA payment, $60 restitution to Schuylkill Medical Center-South Jackson Street and 20 hours community service, with sentence effective at 9 a.m. May 13. Prosecutors withdrew a charge of disregarding traffic lane.
All defendants who were sentenced must pay costs as a part of their sentences.
