A Ringtown man who drove under the influence five times in 2011 will spend time behind bars after being sentenced March 26 in Schuylkill County Court.
George S. Beaver, 54, must serve six to 12 months in prison, and spend an additional 18 months on probation, Judge John E. Domalakes ruled in imposing his sentence.
"If there was ever a case that called for an aggravated sentence, this is it. I hope you avail yourself" of needed treatment, Domalakes said. "You're lucky you're alive."
Beaver pleaded guilty on Feb. 9 to five charges of DUI, plus charges of violation of general lighting requirements, failure to obey traffic control devices, seat belt violation, disregarding traffic lane, no rear lights and reckless driving.
Shenandoah police charged Beaver with DUI on March 13, 2011, and May 20, 2011, West Mahanoy Township police charged him with DUI on April 10, 2011, and state police at Frackville charged him with DUI on Aug. 8, 2011, and Sept. 14, 2011.
"Mr. Beaver obviously has a very serious alcohol problem," District Attorney Karen Noon said.
Domalakes also sentenced Beaver to pay costs, $3,710 in fines and $900 to the Substance Abuse Education Fund.
Also on March 26, Domalakes sentenced Samuel Sanabria, 36, of Shenandoah, to spend six to 23 months in prison, plus an additional 18 months on probation, pay costs, $2,000 in fines and $60 restitution to Schuylkill Medical Center-South Jackson Street, and undergo drug and alcohol and mental health evaluations.
Sanabria pleaded guilty Feb. 2 to carrying a firearm without a license, recklessly endangering another person and propulsion of missiles, which Shenandoah police had charged him with committing on April 8, 2011, in the borough, while on Monday, he pleaded guilty to two DUI charges.
In the first, state police at Frackville alleged Sanabria was DUI on Aug. 5, 2011. Sanabria had an odor of alcohol, glassy and bloodshot eyes, and a blood alcohol level of 0.22 percent, police said; the legal limit for driving in Pennsylvania is 0.08 percent.
In the second, West Mahanoy Township police alleged Sanabria was DUI with a blood alcohol level of 0.26 percent on Sept. 9, 2011, at a sobriety checkpoint on Route 924 in the township.
"He obviously needs to have a lot of help and a lot of supervision," Noon said of Sanabria.
In other county court action:A Cressona man will not have to spend more time in prison after being sentenced March 26 in Schuylkill County Court for unlawfully possessing guns and being disorderly.
Allen R. Howell Jr., 38, was sentenced to time served to 23 months, plus 12 months consecutive probation, by Judge John E. Domalakes, who promptly granted the defendant immediate parole.
Domalakes also sentenced Howell to pay costs and $50 to the Criminal Justice Enhancement Account, and undergo drug and alcohol and mental health evaluations.
Howell pleaded guilty on Feb. 2 to two counts of unlawful possession of firearms and one each of resisting arrest and disorderly conduct. Prosecutors dropped a charge of harassment.
State police at Schuylkill Haven alleged that Howell improperly possessed guns on April 4, 2011, while Pottsville police charged him with being disorderly and resisting arrest on May 24, 2011, in the city.
In other recent county court action, President Judge William E. Baldwin accepted guilty pleas from, and imposed the indicated sentences on, these defendants:
James J. Culley, 27, of Pottsville - harassment; $100 fine. Prosecutors dropped a charge of simple assault.
Peter Koury, 30, of Enola - forgery, theft of services and identity theft; six to 23 months in prison, $50 CJEA payment and submission of a DNA sample to law enforcement authorities.
James W. Martello, 23, of Mount Carmel - criminal trespass, theft and conspiracy; 18 months probation, $50 CJEA payment, $200 restitution, $50 bench warrant fee, 20 hours community service and submission of a DNA sample to law enforcement authorities. Prosecutors dropped a charge of receiving stolen property.
Quinton J. Noti, 47, of Pottsville - possession of a controlled substance and recklessly endangering another person; 23 months probation, $100 payment to the Substance Abuse Education Fund, $50 CJEA payment and $16,338 restitution. Prosecutors dropped charges of criminal mischief and dangerous burning.
Brian J. O'Doherty, 28, of Pottsville - driving under the influence; 72 hours to six months in prison, $1,000 fine, $300 SAEF payment, $50 CJEA payment and $60 restitution to Schuylkill Medical Center-South Jackson Street. Prosecutors dropped a charge of failure to obey traffic control devices.
William L. Quigley Jr., 21, of Pottsville - five counts of theft from a motor vehicle and one of conspiracy; 12 months probation, $50 CJEA payment, $1,710 restitution, 20 hours community service and submission of a DNA sample to law enforcement authorities. Prosecutors dropped five counts of receiving stolen property and one of loitering and prowling at nighttime.
James C. Rehrer, 48, of Pine Grove - two counts of possession of a small amount of marijuana and one each of DUI and possession of drug paraphernalia; 72 hours to six months in prison, 12 months probation, $1,000 fine, $200 in SAEF payments, $100 in CJEA payments, $113 restitution to the state police crime laboratory in Bethlehem and 10 hours community service. Prosecutors dropped a charge of careless driving.
All defendants who were sentenced must pay costs as a part of their sentences.
