A New Ringgold man will spend time in prison after pleading guilty Friday in Schuylkill County Court to a charge of driving under the influence Friday in Schuylkill County Court.

Brian L. Wolfe, 36, must serve five days to six months in prison under the terms of Judge Cyrus Palmer Dolbin's sentence, which the judge imposed immediately after accepting the defendant's plea.

Dolbin also sentenced Wolfe to pay costs, a $300 fine and $100 to the Substance Abuse Education Fund, and perform 10 hours community service.

Tamaqua police charged Wolfe with DUI on July 23, 2011, in the borough.

Prosecutors dropped a charge of disorderly conduct.

Also in the county court, a jury convicted Jerry W. Lucas Jr., 52, of Suedberg, of DUI.

Judge John E. Domalakes, who presided over Lucas' one-day trial, scheduled the defendant's sentencing for 10 a.m. May 21.

State police at Jonestown alleged Lucas was DUI about 5:45 a.m. Feb. 21, 2011, in his southbound pickup truck on Interstate 81 in Pine Grove Township. Lucas had a blood alcohol level of 0.176 percent, according to police; the legal limit for driving in Pennsylvania is 0.08 percent.

Domalakes found Lucas not guilty of disregarding traffic lane, failure to drive at a safe speed and failure to stop and give information.

In other county court action, two men will spend time on house arrest instead of in prison after being sentenced Monday in Schuylkill County Court for driving with a license that had been suspended for a driving under the influence-related incident.

Randy M. Gelbutis, 41, of Shenandoah, and James J. Vita Jr., 56, of Kelayres, each must spend 90 days on house arrest with electronic monitoring and pay costs and a $500 fine, under the terms of Judge Jacqueline L. Russell's sentence.

Gelbutis and Vita each pleaded guilty on March 23 to driving under suspension-DUI related.

State police at Frackville had charged Gelbutis with driving with a suspended license on Nov. 25, 2011. Magisterial District Judge Anthony J. Kilker, Shenandoah, initially found Gelbutis guilty on Jan. 5, but the defendant appealed that ruling Feb 6.

State police at Jonestown had charged Vita with driving with his suspended license on Nov. 23, 2011. Magisterial District Judge Carol A. Pankake, Tremont, found Vita guilty on Feb. 7, but the defendant appealed that ruling on Feb. 22.
