A Pottsville woman is headed to prison after admitting Tuesday in Schuylkill County Court that she was driving under the influence last November in Minersville.
Crystle C. Craig, 26, must serve 10 days in prison under the terms of Judge John E. Domalakes' sentence, which was part of a plea agreement between prosecutors and Craig.
Domalakes also sentenced Craig, who pleaded guilty to DUI, to spend 40 days on house arrest with electronic monitoring and four months and 10 days on probation, pay costs, a $750 fine, $100 to the Substance Abuse Education Fund and $60 restitution to Schuylkill Medical Center-South Jackson Street, and perform 20 hours community service. Domalakes made the sentence effective at 9 a.m. July 16.
"Hopefully ... (it) will help you overcome any problem you may have," Domalakes said. "Hopefully, that won't happen again."
Minersville police charged that Craig was DUI on Nov. 24, 2011, in the borough. Craig had a blood alcohol level of 0.12 percent, police said; the legal limit in Pennsylvania is 0.08 percent.
Domalakes said the police accepted the plea agreement with Craig.
Also on Tuesday, Judge Cyrus Palmer Dolbin sentenced Tiffany A. Botzer, 25, of Pottsville, to serve 60 days to 12 months in prison.
Dolbin imposed the sentence after revoking Botzer's probation, which the defendant had admitted she violated.
Botzer originally pleaded guilty on May 18, 2011, to DUI, possession of a controlled substance, false identification to law enforcement and driving under suspension, which Pottsville police had charged her with committing on July 17, 2010, in the city. Prosecutors dropped charges of adulterated or misbranded controlled substance, failure to keep right and driving unregistered vehicle.
At the time Botzer pleaded guilty, Dolbin sentenced her to spend 72 hours to six months in prison with immediate parole and 12 months concurrent probation, and to pay costs, a $100 SAEF payment, $50 to the Criminal Justice Enhancement Account, $60 restitution to Schuylkill Medical Center-South Jackson Street and $113 restitution to the state police crime laboratory in Bethlehem. Botzer still must pay those amounts under the terms of Dolbin's new sentence.
Dolbin warned Botzer that she could face more prison time if she did not change her ways.
"Good luck to you, Ms. Botzer," he said. "It's not over just because you're walking out of this courtroom."
In another Tuesday case, Dolbin revoked the parole of Eric R. Shappell, 27, of Seltzer, and recommitted him to prison.
Shappell originally pleaded guilty on March 23, 2011, to burglary, criminal trespass and conspiracy. Dolbin sentenced him to serve four to 23 months in prison, pay costs, a $50 CJEA payment and $910 restitution, and submit a DNA sample to law enforcement authorities; Shappell still must pay those amounts, Dolbin ruled.
Pottsville police had charged Shappell with committing his crimes on Aug. 8, 2010, in the city.
Shappell could remain in prison until Oct. 15, 2013, and is not eligible to apply for reparole until Oct. 14 except if he were to go to an inpatient rehabilitation facility.
Also in the county court, a Westmoreland County woman is heading to prison after being sentenced Friday on a retail theft charge.
Cheryl A. Nykiel, 41, of New Kensington, must serve nine to 23 months behind bars, pay costs, a $50 CJEA payment and $45.97 restitution to Kmart, and submit a DNA sample to law enforcement authorities under the terms of Judge Charles M. Miller's sentence.
Miller made the sentence effective at 10 a.m. July 27.
Nykiel pleaded guilty on May 31 to retail theft, which state police at Frackville had charged her with committing on Aug. 8, 2011, at the Kmart department store in Schuylkill Mall in New Castle Township.
Also on Friday, Miller ordered Christopher M. Russell, 35, of Schuylkill Haven, to spend 23 months on probation on a charge of receiving stolen property.
Miller also sentenced Russell to pay costs and a $50 CJEA payment, and undergo a drug and alcohol evaluation.
Russell pleaded guilty on May 31 to receiving stolen property, which Schuylkill Haven borough police had charged him with committing on Aug. 6, 2011, in the borough. Prosecutors dropped a charge of conspiracy.
