In recent Schuylkill County Court action, Judge Cyrus Palmer Dolbin accepted guilty pleas from, and, pursuant to plea agreements between prosecutors and defendants, imposed the indicated sentences on these people:
Richard J. Gilmore, 30, of Pottsville; driving under the influence and driving without a license; five years in the intermediate punishment program, $1,700 in fines, $300 payment to the Substance Abuse Education Fund and $537.50 restitution. Prosecutors withdrew a charge of careless driving.
Tiffanie A. Hasara, 26, of Freeland; retail theft and receiving stolen property; 18 months probation, $50 payment to the Criminal Justice Enhancement Account and $199.97 restitution.
Rachel Ilgenfritz, 29, of Lebanon; retail theft, receiving stolen property and possession of a controlled substance; 23 months probation, $600 in fines, $50 CJEA payment and $413 restitution.
Ian M. Kaufman, 22, of Gordon; conspiracy; six to 23 months in prison.
James B. Keatine, 50, of Middleport; simple assault; 23 months probation and $50 CJEA payment. Prosecutors withdrew charges of harassment and prohibited possession of offensive weapon.
Melissa L. Moldinado, 41, of Birdsboro; retail theft and false identification to law enforcement; 12 months probation, $50 CJEA payment and $175.17 bench warrant fee. Prosecutors withdrew charges of driving under suspension, driving without license and violation of duty of operator.
Bethany A. Sledge, 41, of Watsontown; DUI, disregarding traffic lane and driving under suspension; 48 hours to six months in prison, $675 in fines, $300 SAEF payment, $50 CJEA payment, $60 restitution to Schuylkill Medical Center-South Jackson Street and $175.14 bench warrant fee.
James S. Smith, 47, of Kaska; DUI, driving under suspension and improper driving without lights; 14 months to five years in prison, $2,725 in fines, $300 SAEF payment and $50 CJEA payment. Prosecutors withdrew charges of driving without a license and careless driving.
Robert L. Tabourn, 21, of Ringtown; two counts each of possession of a small amount of marijuana and possession of drug paraphernalia and one each of delivery of a controlled substance and possession with intent to deliver a controlled substance; one to 23 months in prison, $200 in SAEF payments, $100 in CJEA payments, $113 restitution to the state police crime laboratory in Bethlehem and submission of a DNA sample to law enforcement authorities.
Gregory M. Wilson, 23, of Girardville; aggravated assault by vehicle while DUI, DUI and reckless driving; six to 23 months in prison, $500 in fines, $50 CJEA payment, $1,000 restitution and submission of a DNA sample to law enforcement authorities.
In other county court action, a Tamaqua man went free Wednesday in Schuylkill County Court after a judge ruled he did not violate a protection from abuse order in July in his hometown.
George Rinda, 61, is not guilty of indirect criminal contempt, which is contempt committed outside the courtroom, Senior Judge D. Michael Stine ruled after a hearing.
"There was no contact at all," Stine said in deciding the case.
Tamaqua police had charged Rinda with violating the order about 8:30 a.m. July 27 by entering the victim's workplace, Boyer's Food Market, 210 Cedar St., while she was there.
Rinda said he had no idea the victim was in the market when he went in to do some shopping.
"I didn't make eye contact," Rinda testified. "I don't know what her schedule is."
He also said the market declined to give him a copy of the woman's work schedule.
In making his ruling, Stine stressed the fact that the order does not completely bar Rinda from entering the store.
Also on Wednesday, a Tamaqua man returned to prison after admitting he violated his probation and parole.
Michael C. Hill Jr., 21, must remain in prison at least until Nov. 30 unless he goes to a substance abuse treatment facility, and could remain behind bars until Feb. 13, 2014, under the terms of Judge John E. Domalakes' order.
Hill originally pleaded guilty on Dec. 21, 2011, to three counts of conspiracy and one each of burglary and unauthorized use of a motor vehicle. At that time, Domalakes sentenced him to serve 14 days to 23 months in prison, plus 12 months concurrent probation, and pay costs, $100 to the Criminal Justice Enhancement Account and $3,834 restitution, amount he is still required to pay under the judge's new order.
Also on Wednesday, Schuylkill County prosecutors dropped charges against three defendants.
John D. Conahan, 33, of Tamaqua, had been charged with simple assault and harassment. Tamaqua police alleged he committed those crimes on Nov. 20, 2011, in the borough.
Krystal L. Hill, 31, of Schuylkill Haven, had been charged with forgery and bad checks. State police at Schuylkill Haven alleged he committed those crimes on May 27, 2009.
Nadine M. Mason, 29, of Middleport, had been charged with simple assault and harassment. State police at Schuylkill Haven alleged she committed those crimes on July 19.
In each case, President Judge William E. Baldwin signed an order on Wednesday allowing prosecutors to drop the charges and directing the defendant to pay the costs of the case.
