Kline Twp. supervisors to decide fate of trailer

McADOO - Kline Township supervisors held a public hearing Monday to hear both sides of an issue concerning a trailer under consideration for repair, demolition or removal.

The trailer, located at the southern end of Bruno Avenue in Haddock, is owned by Patricia I. Boyke, who lives next door at 32 Bruno Ave.

According to the township, code enforcement officer Glen Everett inspected the trailer last November and found it to be in violation of the dangerous structure ordinance.

Township solicitor Mark Semanchik questioned Everett under oath to determine what problems he found during what was only an outside inspection. Everett, who is certified as a state uniform code enforcement inspector, did not inspect the interior.

He testified that the trailer was not properly anchored to the ground, that he observed broken windows and water damage, and that it had no public water or sewer connections. He said it was not safe for humans to live inside and concluded the unit was not repairable.

"I don't know if the unit needs to be demolished but it should be removed from the property," Everett testified.

Boyke and her 79-year-old father, John Boyke, testified against removal of the property.

Patricia Boyke said no one lives in the trailer now, but that the windows were fixed and the roof wasn't leaking. She said she is in the process of selling the trailer and even accepted a down payment for it.

"I don't agree with him," Boyke said, referring to Everett's assessment of the trailer.

She told Semanchik she wasn't given enough notice to fix other things at the trailer.

Semanchik said she was given enough notice about the property, Monday's hearing and various violations, and that she should have procured legal counsel for the proceeding.

"In my book, that trailer is good and not that dangerous," her father, John Boyke, said during the hearing.

Semanchik recommended that the hearing be adjourned and that the board of supervisors make a decision on the trailer by its next meeting Feb. 13.

The board agreed.

Boyke can appeal that decision in Schuylkill County Court if she does not agree with it.
