A Carbon County man will lose his car in addition to spending time behind bars after pleading guilty Wednesday in Schuylkill County Court to possessing drugs and driving under the influence in September 2010 in West Mahanoy Township.
Christopher B. White, 25, of Weatherly, must serve 90 days to five years in prison under the terms of Judge Charles M. Miller's sentence, which the judge made concurrent to one from Carbon County that the defendant already is serving.
"You reap what you sow in life," Miller told White, who pleaded guilty to two counts of possession of a controlled substance and one each of DUI and possession of drug paraphernalia.
Prosecutors dropped two counts of possession with intent to deliver a controlled substance and one of careless driving.
In addition to the prison term, Miller sentenced White to pay costs, a $1,500 fine, $100 to the Substance Abuse Education Fund and $176 restitution to the state police crime laboratory in Bethlehem.
Additionally, Miller ordered White to forfeit his car to prosecutors. Assistant District Attorney Thomas J. Campion Jr. said the car is a 1999 Plymouth Breeze.
West Mahanoy Township police charged White with DUI and possessing marijuana, MDMA, two pipes, a scale and glassline baggies on Sept. 16, 2010, in the township.
White is in prison until April on his Carbon County case, which also is drug-related.
Also on Wednesday, President Judge William E. Baldwin sentenced Robert J. Stackhouse, 29, of Tamaqua, on DUI and two summary charges.
Baldwin ordered Stackhouse to spend 15 days on house arrest with electronic monitoring, 45 days on strict supervision and four months on probation, and pay costs, $1,550 in fines and a $300 SAEF payment.
Stackhouse pleaded guilty on Dec. 1, 2011, to DUI, disregarding traffic lane and failure to drive at a safe speed. Coaldale police had charged him with committing those crimes on Jan. 30, 2011, in the borough.
In another Wednesday case, a Tower City man will not have to spend time in prison after pleading guilty to three crimes, two drug-related and one vehicle-related.
Bryon C. Swartzlander, 38, must spend 12 months on probation and pay costs, a $200 fine, a $100 SAEF payment, $50 to the Criminal Justice Enhancement Account and $113 restitution to the state police crime laboratory in Bethlehem under the terms of Judge John E. Domalakes' sentence.
Swartzlander pleaded guilty to misbranding of a controlled substance, possession of a controlled substance and driving under suspension, with prosecutors dropping charges of driving an unregistered vehicle, operating vehicle without required financial responsibility and failure to have certificate of inspection. Tower City police charged Swartzlander with committing those offenses on July 30, 2010, in the borough.
Also on Wednesday, Judge Cyrus Palmer Dolbin found Christopher C. Welna, 41, of Shenandoah, not guilty of driving under suspension and operating vehicle without valid inspection.
West Mahanoy Township police alleged Welna committed those offenses on May 20, 2011, in Shenandoah Heights.
A Montgomery County man admitted Thursday in Schuylkill County Court that he stole more than $1,000 worth of merchandise in January 2011 from the Walmart Supercenter in Saint Clair.
John R. Curtis, 35, of Lansdale, pleaded guilty to retail theft, conspiracy and receiving stolen property and was sentenced by Judge John E. Domalakes to serve six to 12 months in prison, pay costs and $1,298.96 restitution, and submit a DNA sample to law enforcement authorities.
Domalakes made the sentence concurrent with the one from Berks County that Curtis presently is serving at State Correctional Institution/Camp Hill.
