Haven driver faces DUI, other charges for hitting woman with truck

ORWIGSBURG - A Schuylkill Haven man is headed to Schuylkill County Court after his Tuesday preliminary hearing on charges he was intoxicated when his pickup truck hit a woman during a snowstorm last Christmas Eve.

Robert V. Boyer, 55, of 39 E. William St., must defend against charges of driving under the influence, recklessly endangering another person, stop sign violation and careless driving.

At the end of the hearing, Magisterial District Judge James R. Ferrier ruled prosecutors had produced sufficient evidence to support all charges and ordered them held for the county court.

Ferrier allowed Boyer to remain free on $1,000 unsecured bail pending further court action.

State police at Schuylkill Haven alleged that Boyer was DUI about 7:45 p.m. Dec. 24, 2012, when his red 2001 Chevrolet Silverado hit Patti Jo Moyer, Summit Station, at Navajo and Mohave drives, Lake Wynonah, Wayne Township, inflicting serious injuries on her.

Police said Boyer lost control of his truck, which slid through a stop sign. The back end of the truck slid and hit Moyer, who was walking along the berm of Navaho Drive, police said.

Boyer said he had consumed one or two beers that day, according to police.

However, Boyer's blood alcohol level was 0.121 percent, police said; the legal limit for driving in Pennsylvania is 0.08 percent.

"While inside the heated patrol car (with Boyer), a strong odor of alcoholic beverage could be smelled," according to the Affidavit of Probable Cause.
