Criminal court, April 2, 2013

A Luzerne County man returned to prison Monday after being sentenced in Schuylkill County Court following revocation of his probation.

Francisco Alvarez, 19, of West Hazleton, must serve 45 days to 12 months behind bars under the terms of Judge John E. Domalakes' sentence.

Domalakes ruled prosecutors had proven that Alvarez violated his probation by failing to report to his supervising officer and moving without permission.

Alvarez originally pleaded guilty on Jan. 18, 2012, to theft and receiving stolen property. At that time, Domalakes accepted Alvarez's plea, placed him on probation for 12 months and also sentenced him to pay costs and $50 to the Criminal Justice Enhancement Account.

Shenandoah police charged Alvarez with committing the theft on May 13, 2011, in the borough.

In other recent Schuylkill County Court action, President Judge William E. Baldwin accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:

John P. Colon, 19, of Mahanoy City; four counts of possession with intent to deliver a controlled substance, two of possession of a controlled substance and one of possession of drug paraphernalia; four years probation, $400 in payments to the Substance Abuse Education Fund, $200 in CJEA payments, $956 restitution to the state police crime laboratory in Bethlehem and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew one count each of possession of a controlled substance, possession of drug paraphernalia and possession of a small amount of marijuana.

Tammy J. McShaw, 44, of Pottsville; three counts of possession of a controlled substance and one each of conspiracy, attempted possession of a controlled substance, retail theft and possession of drug paraphernalia; sentencing deferred until 9 a.m. May 8 pending preparation of a presentence investigation.

John F. Murphy, 48, of Minersville; delivery of a controlled substance; five to 23 months in prison, $100 SAEF payment, $113 restitution to the state police crime laboratory in Bethlehem, 20 hours community service and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew a charge of possession of a controlled substance.

John P. Phillips, 58, of Ringtown; no contest plea to terroristic threats and simple assault; six to 23 months in prison. Prosecutors withdrew a charge of recklessly endangering another person, harassment and disorderly conduct.

Kathy L. Rummel, 28, of Pottsville; driving under the influence; 72 hours to six months in prison, $1,000 fine, $300 SAEF payment and $60 restitution to Schuylkill Medical Center-South Jackson Street.

Marissa Stevens, 24, of Delano; receiving stolen proeprty and theft by deception; 18 months probation.
